1. Eligibility And Authority

You must be legally able to enter into a binding agreement and, if acting for a company or organization, you represent that you have authority to bind that entity.

2. Service Description

MailTeek provides software for outbound email operations, mailbox connection management, campaign execution, reply and bounce processing, analytics, and related workflow tooling.

MailTeek is not an email service provider and does not own or operate the customer outbound mailbox infrastructure used to send messages unless explicitly stated otherwise in a separate written agreement.

3. Customer Responsibilities

• Use the platform lawfully and in compliance with applicable anti-spam, privacy, consumer protection, export, and communications laws.
• Maintain valid rights to the mailbox accounts, domains, contact data, and content used through the service.
• Honor unsubscribe requests, suppression obligations, consent rules, and recipient rights where required.
• Keep account credentials secure and limit access to authorized users only.

4. Acceptable Use

• You may not use MailTeek to send illegal, deceptive, fraudulent, abusive, malicious, infringing, or harassing messages.
• You may not attempt to evade provider limits, exploit the system, interfere with the service, or access data that is not yours.
• We may suspend or restrict accounts that create material abuse, security, payment, legal, or reputational risk.

5. Third-Party Providers

Use of Google, Microsoft, SMTP providers, IMAP providers, DNS providers, and other third-party services remains subject to those providers terms and technical limitations.

If a provider revokes access, rate-limits requests, blocks traffic, or changes its APIs or mailbox rules, service behavior may be affected without liability to MailTeek.

6. Billing, Renewals, And Taxes

Paid plans are billed in advance on a recurring basis according to the billing interval selected at checkout. Unless otherwise stated, subscriptions renew automatically until canceled.

You authorize MailTeek and its payment processors to charge the payment method on file for subscription fees, overages, taxes, and other authorized charges.

Prices exclude applicable taxes unless expressly stated otherwise. You are responsible for applicable sales, use, VAT, GST, withholding, or similar taxes other than taxes based on our net income.

7. Trials, Promotions, Failed Payments, And Collections

• Free trials or promotions may be limited, withdrawn, modified, or subject to verification and anti-abuse controls.
• If payment fails, we may retry charges, suspend features, downgrade the account, or pause access until the account is brought current.
• We may use collection tools, payment reminders, and account restrictions for overdue balances.

8. Refunds And Chargebacks

Except where required by law or expressly stated in a separate written refund policy, fees are non-refundable once billed. Initiating a payment dispute or chargeback without first contacting support may result in account suspension while the matter is reviewed.

9. Suspension And Termination

We may suspend, limit, or terminate access immediately where necessary to address abuse, security threats, legal risk, non-payment, or material breach of these Terms.

You may stop using the service at any time, but cancellation does not erase accrued payment obligations or charges already incurred.

10. Intellectual Property

MailTeek retains all rights in the software, branding, documentation, product design, and platform materials, excluding customer content and third-party materials.

11. Disclaimers

The service is provided on an as-is and as-available basis. We do not guarantee uninterrupted service, deliverability, provider acceptance, inbox placement, or campaign performance.

12. Limitation Of Liability

To the maximum extent permitted by law, MailTeek will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data.

To the extent liability cannot be excluded, MailTeek total aggregate liability for claims arising out of the service will not exceed the amount paid by the customer to MailTeek for the service during the three months preceding the event giving rise to the claim.

13. Indemnity

You agree to defend, indemnify, and hold harmless MailTeek from claims, losses, liabilities, and expenses arising from your content, campaigns, recipient data, violations of law, or misuse of the platform.

14. Changes To The Service Or Terms

We may update the service, plans, pricing, and these Terms from time to time. Changes take effect when posted unless a later date is stated.
